These Terms explain how you may use VidCaption. Please read them carefully. By accessing or using our website and services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, uploading files, or otherwise using VidCaption ("Service"), you confirm that you accept these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, you must not use the Service.
You must be legally able to enter a binding agreement in your jurisdiction. If you use VidCaption on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of Service
VidCaption allows users to upload video or audio files and generate captions and subtitles (such as transcript text and timed subtitle formats) for personal or professional use, subject to these Terms and your plan limits.
The Service processes uploads temporarily to extract audio where needed and to produce captions. Uploaded files are not stored permanently and are deleted after processing in line with our Privacy Policy.
Features, limits, and availability may change over time. We do not guarantee uninterrupted access or that the Service will meet every use case.
3. User Responsibilities
You are responsible for the content you upload and for complying with applicable laws. You must provide accurate account information and keep your login credentials secure.
You are responsible for reviewing captions for accuracy and fitness before publishing or relying on them (for example, for broadcast or accessibility compliance).
4. Acceptable Use
You agree not to use VidCaption to upload, process, or distribute content that is illegal, infringes others' rights, or is harmful—including but not limited to content that is abusive, harassing, hateful, exploitative, or that violates privacy or intellectual property laws.
You must not misuse the Service (for example, attempting to disrupt systems, scrape data without permission, or circumvent usage limits). We may suspend or terminate access for violations.
5. File Upload & Processing
When you upload files, VidCaption processes them only to deliver the Service (for example, to extract audio from video where applicable and to generate captions). Processing is temporary.
We do not claim ownership of your content. You retain ownership of your videos and other materials, subject to the license implied by using the Service (namely, permission for us to process what you upload so we can provide captions).
File size or duration limits, upload quotas, and hosting constraints may apply. If an upload cannot be completed, you may need to try a different file or contact support.
6. Intellectual Property
VidCaption and its branding, software, and materials are owned by us or our licensors and are protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.
Outputs generated for you from content you lawfully upload may be used by you according to your rights in your original content and applicable law; we do not sell your uploads or outputs as separate intellectual property products.
7. Subscription & Billing
VidCaption may offer Free, Pro, and Enterprise plans (or similarly named tiers). Features, prices, and limits are described on our pricing page or at checkout and may be updated with reasonable notice where required.
Paid subscriptions renew according to the billing cycle you select unless cancelled as permitted by the checkout provider or these Terms. Taxes may apply based on your location.
Enterprise or custom agreements may include additional terms; where they conflict with these Terms on specific points, the written enterprise agreement controls for that customer.
8. Credits Usage
Certain actions consume credits. Unless stated otherwise on our website, one (1) credit represents approximately one minute of processed audio for transcription-style processing (partial minutes are typically counted in full according to the rules shown in-product).
Translation or other add-on features may cost additional credits per use. Free and paid plans may apply different monthly credit amounts or limits on specific features.
Credits rollover: Unused credits do not roll over to the next billing period unless otherwise stated at checkout or in a separate written agreement.
9. Refund Policy
Because VidCaption delivers digital services that begin when you use credits or processing capacity, fees are generally non-refundable once usage has occurred or the billing period has begun, except where required by law or expressly stated at purchase.
If you believe a charge is incorrect, contact us promptly at the email below. We will review good-faith disputes and processor rules that apply to your payment method.
10. Limitation of Liability
To the fullest extent permitted by law, VidCaption and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for claims arising out of these Terms or the Service is limited to the greater of (a) the amount you paid us for the Service in the three (3) months before the claim or (b) a small fixed amount where no fees were paid—except where liability cannot be limited under applicable law.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available." We do not warrant that captions will be error-free, complete, or suitable for every regulatory or accessibility requirement. Service availability and accuracy are not guaranteed at 100%.
12. Account Suspension or Termination
We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service with reasonable notice where practicable.
You may stop using VidCaption at any time. Provisions that by their nature should survive (such as liability limits and intellectual property) will survive termination.
13. Third-Party Services
VidCaption may rely on third parties (for example, sign-in, payments, or infrastructure). Those providers have their own terms and privacy practices. We are not responsible for third-party services beyond what the law requires.
14. Changes to Terms
We may update these Terms from time to time. We will post the revised Terms with a new effective date. Continued use after changes means you accept the updated Terms, unless applicable law requires additional steps (such as explicit consent for material changes).
15. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of India. Nothing in these Terms limits any consumer rights that may apply under the laws of your country of residence.
